Superior’s Primary Turns Messy With Contested 5th Dist Candidate

An incumbent staging a re-election run in Superior is having his candidacy challenged - along with a submitted "correction" form.  Current 5th District City Councilor Brent Fennessey submitted the petition form to get his name on the ballot; 4th District resident Garner Moffat has challenged the form, pointing out that Fennessey didn't complete it in the proper order.  Fennessey revised that original petition - following protocols - however, Moffat contends that he did so after the deadline that was allowed.

According to news sources, Moffatt challenged the number of signatures on the original petition - suggesting that some weren't valid - leaving Fennessey without the required amount to get his name on the ballot. That complaint triggered action by Superior's City Clerk Teri Kalan to allow Fennessey the opportunity to file an affidavit of correction.  That correction had a specific time limit on it - ended by the close of business as a deadline (5:00 PM).  Moffatt contends that Kalan accepted the correction after the close of business, because the office closed for the day at 4:30 PM and the form was timed at 4:42 PM.

The Wisconsin Elections Commission staff counsel has contacted Kalan to solicit a response to the challenger on January 23, 2020.   She has 10 days to respond.
