A new bill introduced in the 94th Minnesota Legislature is already sparking debate across the state about guns and what should and should not be allowed to be owned in Minnesota.

What Is Minnesota Bill HF 3433?

The entirely partisan bill, authored by 35 members of the Democratic-Farmer-Labor Party, is being led by Representative Emma Greenman. She represents the district where the Annunciation Catholic School shooting occurred on August 27, 2025.

Bill HF 3433 is a comprehensive proposal to ban the possession and transfer of what it defines as semiautomatic military-style assault weapons in Minnesota.

How The Definition Would Change

The bill begins by amending existing law to expand the definition of semiautomatic military-style assault weapons.

It includes specific named models, including the AK-47 and AR-15, and uses a features test that classifies firearms based on characteristics such as pistol grips, folding stocks, or the capacity to accept detachable magazines, among other criteria.

If passed, beginning January 1, 2027, it would be unlawful for anyone to own, possess, or transfer the named weapons in Minnesota. The only exceptions would be for law enforcement, government agents, and members of the armed forces acting within the scope of their duties.

What About Guns Already Owned in Minnesota?

As for grandfathering weapons already owned before the prohibition date, current owners could request certification from the Minnesota Bureau of Criminal Apprehension by May 1, 2027.

If certification is granted, owners would have to meet strict storage requirements, allow inspections by law enforcement, and renew that certification every three years.

Gun owners who choose not to certify, or who inherit a banned weapon after the law takes effect, would be required to surrender the weapon to law enforcement for destruction or move it out of state.

Where The Bill Stands

The bill is in the very early stages of the legislative process and faces an uphill battle. However, Governor Tim Walz has made it a cornerstone of his 2026 Gun Violence Prevention package, signaling that the proposal will remain a major topic of discussion in St. Paul and throughout the state.
